Welcome to Lunéa Paris. The terms “Lunéa Paris,” “we,” “us,” and “our” refer to Lunéa Paris Inc.

Lunéa Paris operates this website and online store, including all related information, content, features, tools, products, and services offered through the website, collectively referred to as the “Services.”

Our store is hosted by Shopify, which provides the e-commerce platform that enables us to offer the Services to you.

These Terms of Service, together with any policies referenced in them, describe your rights and responsibilities when accessing or using the Services.

Please read these Terms carefully. They contain important information concerning your legal rights, including warranty disclaimers, limitations of liability, and dispute provisions.

By visiting, accessing, interacting with, or using the Services, including purchasing a product from us, you agree to be bound by these Terms of Service and our Privacy Policy.

SECTION 1 — ELIGIBILITY, ACCESS AND ACCOUNTS

By using the Services, you represent that you are at least the age of majority in your state, province, or country of residence.

If you are not the age of majority, you may use the Services only with the involvement and consent of a parent or legal guardian.

To browse our store, create an account, or place an order, you may be required to provide information including your name, email address, billing address, shipping address, telephone number, and payment details.

You represent and warrant that all information you provide is accurate, current, complete, and lawfully provided.

If you create an account, you are responsible for maintaining the confidentiality of your login credentials, restricting access to your account and devices, keeping your account information current, and all activity conducted through your account.

You may not sell, transfer, assign, share, or license your account to another person.

We reserve the right to refuse service, suspend accounts, or terminate access to the Services when reasonably necessary to protect Lunéa Paris, our customers, Shopify, or third parties.

SECTION 2 — PRODUCTS AND PRODUCT INFORMATION

We make reasonable efforts to present product descriptions, colors, materials, measurements, carat weights, stone details, metal specifications, availability, and images as accurately as possible.

However, product colors and appearance may vary slightly depending on your device, display settings, screen quality, lighting conditions, photography, manufacturing tolerances, and the natural or laboratory-grown characteristics of individual gemstones.

Diamond and gemstone carat weights, dimensions, color, clarity, and other specifications may vary slightly within accepted manufacturing and grading tolerances.

Minor variations that do not materially affect the quality, use, or description of a product may not be considered defects.

Nothing in this section limits any rights you may have regarding products that are defective, damaged, materially misdescribed, or otherwise nonconforming.

Diamond grading reports or certifications referenced on the Services may be issued by independent third-party laboratories, including IGI or GIA where applicable.

Lunéa Paris does not control the grading methods, opinions, standards, or conclusions of independent laboratories. Certification information will be provided where expressly included with the product.

All product descriptions, images, prices, specifications, and availability are subject to change without notice.

We reserve the right to modify or discontinue products, limit product quantities, restrict sales by customer, account, household, region, or jurisdiction, correct product information, and refuse orders that appear intended for unauthorized resale.

Products may be available exclusively online and may have limited quantities.

Unless we expressly state otherwise, products purchased through the Services are intended for personal or household use and not for commercial resale or export.

SECTION 3 — CUSTOM AND MADE-TO-ORDER JEWELRY

Certain Lunéa Paris products may be custom-made, personalized, engraved, resized, modified, or produced specifically for the customer.

Custom and made-to-order products may require additional processing time.

Once production has begun, custom, personalized, engraved, resized, modified, or made-to-order jewelry may not be eligible for cancellation, return, or exchange, except where the item is defective, damaged, incorrect, or applicable law requires otherwise.

Customers are responsible for carefully reviewing all selected specifications before placing an order, including ring size, metal type, metal color, stone shape, carat weight, engraving, personalization, and other customization details.

SECTION 4 — ORDERS AND ORDER ACCEPTANCE

When you submit an order, you are making an offer to purchase the selected products under these Terms.

An order confirmation email acknowledges that we received your order. It does not necessarily mean that your order has been accepted, approved for production, or shipped.

Your order is accepted when we confirm that it has been approved for fulfillment, begin production of a custom item, dispatch the order, or otherwise expressly confirm acceptance.

We reserve the right to refuse, limit, or cancel an order for legitimate business reasons, including product unavailability, pricing or description errors, suspected fraud, unauthorized payment, payment-verification issues, shipping restrictions, suspected resale activity, violation of these Terms, or technical and inventory errors.

If we cancel an order after payment has been collected, the amount charged for the cancelled portion will be refunded to the original payment method.

We may contact you using the email address, telephone number, billing address, or shipping information submitted with your order.

Please review your order carefully before submitting it. We cannot guarantee that an order can be modified or cancelled after it has entered processing, production, or fulfillment.

Purchases are subject to our Return, Refund & Exchange Policy.

SECTION 5 — PRICES, TAXES AND PAYMENT

Prices, discounts, offers, and promotions may change without notice.

The price charged will be the price displayed at checkout when your order is submitted, subject to correction of obvious pricing or technical errors.

Unless otherwise stated, prices do not include sales tax, shipping charges, handling charges, customs duties, import taxes, brokerage fees, or other government charges.

Any applicable taxes and charges will be calculated or disclosed during checkout when possible.

International customers are responsible for customs duties, import taxes, brokerage fees, and other charges imposed by the destination country unless they are expressly collected by Lunéa Paris during checkout.

Prices displayed online may differ from prices available through other sales channels, promotions, marketplaces, showrooms, or physical locations.

Promotional offers may be governed by separate terms. When promotional terms conflict with these Terms, the specific promotional terms will apply to that promotion.

You agree to provide current, complete, and accurate payment and billing information.

By submitting payment information, you represent that you are authorized to use the selected payment method, the information provided is accurate, you authorize us and our payment providers to charge the applicable amount, and you are responsible for all authorized charges associated with your order.

Payment processing may be handled by Shopify Payments or other third-party payment or financing providers.

Your use of those services may also be subject to their terms, eligibility requirements, lending disclosures, and privacy policies.

SECTION 6 — SHIPPING AND DELIVERY

Shipping and delivery estimates are provided for convenience and are not guaranteed unless we expressly state otherwise.

Processing time is separate from the shipping carrier’s estimated delivery time.

Delivery may be affected by carrier delays, customs processing, severe weather, natural disasters, labor disruptions, high-volume periods, incorrect or incomplete addresses, government restrictions, or other events outside our reasonable control.

Customers are responsible for providing a complete and accurate shipping address.

Lunéa Paris is not responsible for delays or failed deliveries caused by an incorrect or incomplete address provided by the customer.

Responsibility for merchandise generally transfers to you upon confirmed delivery, except where applicable law provides otherwise.

If your order appears lost, damaged, stolen, or significantly delayed in transit, contact us promptly so we can review the available tracking information and determine whether a carrier investigation or claim is appropriate.

We may require information, photographs, documentation, or cooperation from you when submitting a carrier claim.

A carrier’s delivery confirmation may be considered evidence of delivery, but we will review reported delivery issues individually.

If we are unable to ship your order within the promised or legally required timeframe, we may contact you to offer a revised shipment date or the option to cancel the affected order for a refund.

SECTION 7 — RETURNS, REFUNDS AND EXCHANGES

Returns, refunds, exchanges, and store credit are governed by our Return, Refund & Exchange Policy.

Eligible return requests generally must be submitted within 7 days after delivery.

Custom, personalized, engraved, resized, modified, or made-to-order jewelry may not be eligible for return or exchange except where the item is defective, damaged, incorrect, or applicable law requires otherwise.

Depending on the circumstances and eligibility of the returned merchandise, an approved return may qualify for a refund to the original payment method, an exchange, or store credit.

Return-shipping responsibility depends on the reason for the return.

Lunéa Paris will generally cover reasonable return-shipping costs when an item is damaged, defective, or incorrect due to our error.

Customers are generally responsible for return-shipping costs for eligible returns involving size, preference, or change of mind.

Returned jewelry is subject to inspection and identity verification.

Nothing in these Terms limits any mandatory return, warranty, withdrawal, or consumer-protection rights available under applicable law.

SECTION 8 — PROMOTIONS, DISCOUNTS AND GIFT CARDS

Promotional codes, discounts, gifts with purchase, complimentary jewelry, financing offers, and special promotions may be subject to additional conditions, including expiration dates, minimum purchase requirements, product exclusions, customer eligibility, geographic restrictions, and usage limits.

Unless expressly stated otherwise, discounts cannot be combined, discounts cannot be applied retroactively, promotions have no cash value, promotional products are subject to availability, and gift cards cannot be redeemed for cash except where required by law.

A complimentary or promotional product may be required to be returned when the qualifying purchase is returned.

If a promotional product is not returned, its stated or reasonable retail value may be deducted from the customer’s refund where permitted by applicable law and disclosed in the promotion terms.

We reserve the right to modify, suspend, cancel, or refuse a promotion in cases of error, abuse, fraud, technical malfunction, or violation of the promotional terms.

SECTION 9 — INTELLECTUAL PROPERTY

The Services and their contents are owned by or licensed to Lunéa Paris and are protected by intellectual property laws.

Protected content may include brand names, trademarks, logos, product names, jewelry designs, photographs, videos, graphics, text, product descriptions, page layouts, website design, audio, software, illustrations, and marketing materials.

You may access and use the Services only for lawful, personal, and noncommercial purposes.

Without our prior written permission, you may not copy or reproduce our content, modify or create derivative works, republish or distribute our content, use our product images commercially, download or store substantial portions of the website, sell or license our content, remove intellectual-property notices, use our trademarks, names, logos, or designs, or misrepresent an affiliation with Lunéa Paris.

No provision of these Terms grants you ownership of or a license to our intellectual property except for the limited right to access the Services in accordance with these Terms.

Shopify’s trademarks and intellectual property belong to Shopify or its licensors.

Other names, marks, and content appearing through the Services may belong to their respective owners.

SECTION 10 — ACCEPTABLE USE AND PROHIBITED CONDUCT

You may use the Services only for lawful purposes.

You may not use the Services to violate any applicable law or regulation, commit fraud, submit unauthorized payments, infringe intellectual-property rights, harass or harm another person, submit false or misleading information, impersonate another person or organization, distribute malware, send spam, collect personal information without authorization, interfere with the operation or security of the Services, circumvent security or payment controls, conduct unauthorized scraping or data extraction, make fraudulent or abusive purchases, or commercially exploit any portion of the Services without permission.

We may restrict, suspend, or terminate access when we reasonably believe a person has violated these Terms or poses a risk to Lunéa Paris, Shopify, our customers, or third parties.

SECTION 11 — OPTIONAL TOOLS AND THIRD-PARTY SERVICES

We may provide access to applications, payment options, financing services, social-media features, diamond-certification databases, or other tools operated by third parties.

We do not control all third-party tools and cannot guarantee their availability, security, accuracy, grading standards, or performance.

Third-party tools may be provided “as is” and “as available,” subject to applicable law.

Your use of third-party services is at your discretion and may be governed by separate terms and privacy policies.

We are not responsible for losses caused solely by a third-party tool or service outside our reasonable control, except where applicable law provides otherwise.

We may introduce, modify, or discontinue optional features at any time.

SECTION 12 — THIRD-PARTY LINKS

The Services may contain links to websites, platforms, content, certification databases, or services operated by third parties.

These links are provided for convenience and do not necessarily constitute an endorsement.

We do not control and are not responsible for the content, security, privacy practices, products, services, or grading information of third-party websites.

You should review the terms, policies, and practices of any third party before submitting information or completing a transaction.

Questions or complaints concerning a third-party product or service should generally be directed to the applicable third party.

SECTION 13 — RELATIONSHIP WITH SHOPIFY

Lunéa Paris is powered by Shopify, which provides the technology that enables us to operate the online store.

Purchases made through our store are transactions directly between you and Lunéa Paris.

Shopify is not the seller of Lunéa Paris products and is not responsible for product descriptions, jewelry specifications, order fulfillment, shipping, returns, product quality, customer service, or disputes arising from purchases from Lunéa Paris.

To the fullest extent permitted by law, you release Shopify and its affiliates from claims arising solely from products and transactions between you and Lunéa Paris.

Nothing in this section limits any rights that cannot legally be waived.

SECTION 14 — PRIVACY

Our collection and use of personal information are governed by our Privacy Policy.

Because our store is hosted by Shopify, Shopify may collect and process information relating to your access to and use of the Services in order to host, operate, secure, and improve the platform.

Information may also be shared with service providers involved in payment processing, financing, shipping, fulfillment, fraud prevention, website hosting, analytics, advertising, customer support, certification, and legal compliance.

Some service providers may process information in countries other than the country where you reside.

You may submit reviews, photographs, videos, comments, suggestions, ideas, or other content, collectively referred to as “Feedback.”

By submitting Feedback, you grant Lunéa Paris a nonexclusive, worldwide, royalty-free, transferable, and sublicensable license to use, reproduce, modify, publish, display, distribute, translate, and create derivative works from that Feedback for purposes including operating the Services, improving our products, customer support, marketing, advertising, social media, and commercial promotion.

This license continues unless applicable law requires otherwise.

You represent that you own or control the necessary rights to the Feedback, the Feedback is accurate to the best of your knowledge, the Feedback does not violate another person’s rights, the Feedback does not contain unlawful, defamatory, deceptive, or harmful material, and you have disclosed any material compensation or incentive connected to the Feedback.

You remain responsible for the Feedback you submit.

We may monitor, edit, refuse, or remove Feedback that violates these Terms or applicable law.

We are not required to keep Feedback confidential, pay compensation for Feedback, publish Feedback, or respond to Feedback.

SECTION 16 — ERRORS, INACCURACIES AND OMISSIONS

The Services may occasionally contain errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, carat weights, dimensions, stone specifications, availability, shipping charges, delivery estimates, images, measurements, or inventory.

We reserve the right to correct errors and update information at any time.

If an error materially affects an order, we may contact you to confirm the corrected information, offer an alternative, cancel the affected portion, or issue an appropriate refund.

We are not obligated to honor an obvious pricing or technical error when a reasonable customer would recognize that the displayed information was incorrect.

Nothing in this section limits rights provided under applicable consumer-protection law.

SECTION 17 — SUSPENSION AND TERMINATION

We may suspend or terminate your account or access to the Services if we reasonably determine that you violated these Terms, engaged in fraud or unlawful conduct, abused our policies, threatened the security of the Services, harmed Lunéa Paris, Shopify, another customer, or a third party, or used the Services for unauthorized commercial purposes.

Termination does not affect obligations or liabilities that arose before termination.

Sections concerning intellectual property, Feedback, disclaimers, liability, indemnification, governing law, and other provisions that by their nature should survive will continue after termination.

SECTION 18 — DISCLAIMER OF WARRANTIES

We make reasonable efforts to operate the Services accurately, securely, and reliably.

However, except where expressly stated or required by law, the Services are provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, we do not guarantee that the Services will always be uninterrupted or error-free, website information will always be complete or current, every feature will remain available, the Services will be free from every harmful component, or every product will meet subjective preferences or expectations.

Any express jewelry warranty offered by Lunéa Paris will be governed by the written terms of that warranty.

Nothing in these Terms excludes or limits mandatory consumer guarantees, rights concerning defective or materially misdescribed products, rights that cannot legally be waived, or liability that cannot legally be excluded.

Some jurisdictions do not permit certain warranty exclusions. In those jurisdictions, the exclusions apply only to the extent permitted by law.

SECTION 19 — LIMITATION OF LIABILITY

To the fullest extent permitted by law, Lunéa Paris and its owners, officers, employees, affiliates, agents, contractors, service providers, and licensors will not be liable for indirect, incidental, special, punitive, or consequential damages arising from your use of or inability to use the Services, delays or interruptions, loss of data, lost profits or revenue, unauthorized account activity not caused by our failure to use reasonable care, or third-party services outside our reasonable control.

Where liability cannot be fully excluded, our liability will be limited to the maximum extent permitted by applicable law.

Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, violation of mandatory consumer rights, or any liability that cannot legally be excluded or limited.

Some jurisdictions do not permit certain liability limitations. In those jurisdictions, these limitations apply only to the extent permitted by law.

SECTION 20 — INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless Lunéa Paris and its affiliates, owners, officers, employees, agents, contractors, service providers, and licensors from third-party claims, losses, damages, and reasonable legal expenses arising directly from your unlawful use of the Services, fraudulent or intentional misconduct, material violation of these Terms, infringement of another person’s intellectual property or legal rights, or unauthorized commercial exploitation of the Services.

This obligation does not apply to claims caused by Lunéa Paris’s own negligence, unlawful conduct, or breach of these Terms.

We will provide reasonable notice of an indemnified claim and may coordinate the defense and settlement of the claim.

SECTION 21 — SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed from the Terms.

The remaining provisions will continue in effect.

SECTION 22 — WAIVER

Our failure to exercise or enforce a right under these Terms does not waive that right.

A waiver is effective only when expressly provided in writing by an authorized representative of Lunéa Paris.

SECTION 23 — ENTIRE AGREEMENT

These Terms, together with our posted policies and any applicable promotional terms, constitute the entire agreement between you and Lunéa Paris concerning your use of the Services.

They supersede prior communications or agreements concerning the same subject matter.

If there is a conflict between these Terms and a specific written policy concerning a particular issue, the more specific policy will govern that issue.

SECTION 24 — ASSIGNMENT

You may not transfer or assign your rights or obligations under these Terms without our prior written consent.

We may assign or transfer our rights and obligations as part of a merger, acquisition, sale of assets, corporate restructuring, or transfer of the business.

Any assignment will remain subject to applicable law.

SECTION 25 — GOVERNING LAW AND JURISDICTION

These Terms and any dispute arising from them are governed by the laws of the State of New York, without regard to conflict-of-law principles.

Subject to any mandatory rights or jurisdictional protections available to consumers, disputes relating to these Terms or the Services will be brought in the state or federal courts located in New York County, New York.

Nothing in this section deprives a consumer of mandatory protections available under the laws of the consumer’s place of residence when those rights cannot legally be waived.

SECTION 26 — INTERNATIONAL AND EUROPEAN CONSUMER RIGHTS

Customers located outside the United States may have rights under the mandatory consumer laws of their place of residence.

These Terms are not intended to eliminate rights that cannot legally be waived.

For eligible purchases shipped to consumers in the European Union, customers may have a statutory right to withdraw from an online purchase within 14 days after delivery, subject to applicable exceptions and requirements.

Custom, engraved, personalized, resized, modified, or made-to-order jewelry may be excluded from this right where permitted by applicable law.

SECTION 27 — CHANGES TO THESE TERMS

We may update these Terms periodically to reflect changes in our Services, policies, business practices, technology, or legal and regulatory requirements.

The current version will be posted on this page with a revised “Last updated” date.

Changes apply from the effective date stated in the updated Terms.

Your continued use of the Services after the effective date means you accept the updated Terms, except where applicable law requires another form of consent.
